Abstract
This paper reviews the historical background to civil litigation modeling from an economic perspective. After developing a description of the full civil litigation process as it presently exists in South Africa a complete game theoretic model is presented. Various aspects of this model are then discussed. It is clear from the preliminary model that there exists a strong theoretical support for the concept that the civil litigation process favours players who understand the underlying game theoretic elements and discriminates against individuals without the ability to analyse the model.
