Abstract
Data Privacy within Department of Home Affairs (DHA) and South African Police Service (SAPS) has been a continuous topic of discussion since the advent of the Protection of personal Informal Act (POPIA). Both the SAPS and the DHA are lacking behind in the migration from paper based information management systems and records system to digital based system. This study also entails an assessment of the level of compliance of the DHA and SAPS of the POPIA. Additionally, it reviews cases of government’s non compliance with POPIA and some of the recent Information Regulator (IR) rulings. The study is important given recent data breaches at the government institutions, which have raised serious privacy concerns regarding personal information protection of south African citizens and data subjects.
