In the last few years, artificial intelligence is revolutionising numerous sectors and has a strong impact on the issue of data protection. AI also raises several concerns regarding privacy and information security. There have been many challenges surrounding the breach of personal information and data privacy in South Africa. The challenge for courts has been to establish who has the responsibility of protecting personal information and addressing the challenges that came with protecting personal data in the cyberspace. For this reason, this dissertation explores the difficulties associated with safeguarding data in cyberspace, examining cybersecurity as an issue as well as the parties accountable for data protection.
