Abstract
This study focuses on the protections available to consumers in browse wrap and click wrap contracts, as consumers are faced with many challenges in electronic transactions. Consumer protection rights in South Africa are commendable and includes legislative interventions such as the Electronic Communications and Transactions Act 25 of 2002 and the Consumer Protection Act 68 of 2008, which have both played major roles in consumer protection. However, it remains of great importance to continue enhancing and safeguarding the rights of consumers particularly in the online environment. To this end, the study will consider whether consumers entering into browse wrap and click wrap contracts are sufficiently protected by the South African legislative landscape, and whether there is a need to supplement such protection for consumers.
