Abstract
Legal challenges in regulating deepfake technology
As deepfake technology becomes increasingly prevalent, society finds itself navigating the
complexities of artificial intelligence (AI) in everyday life. While global awareness of AI is
growing, the acceptance and integration of these technologies vary significantly between the
Global North and South. In South Africa, the embrace of AI lags that of jurisdictions like China,
where businesses and governments proactively implement measures to harness technological
advancements. Although South Africa is making strides toward the Fourth Industrial Revolution
through educational initiatives and institutional transformation, the extent of this embrace remains
limited.
This disparity raises critical concerns about the implications of deepfake technology, particularly
in a society already grappling with socioeconomic and political challenges. The unchecked
dissemination of information via social media platforms, alongside the absence of robust
regulatory frameworks, exacerbates the risk of disinformation and the erosion of democratic
values. As the public’s exposure to transformative technologies increases, many remain unaware
of the potential consequences, especially in remote villages and disadvantaged urban areas. While
deepfake technology presents significant challenges related to disinformation, cybersecurity fraud
and public safety, it also offers opportunities for innovation and creativity in fields such as digital
marketing, filmmaking, and content creation, highlighting the need for a nuanced approach to
regulation that balances protection with potential economic opportunities and advancement in
creative spaces.
This minor dissertation aims to examine the legal challenges of regulating deepfake technology
in South Africa, drawing comparisons with the approaches taken in China and the European
Union. By identifying gaps in South Africa’s legal framework and learning from the proactive
measures adopted by other jurisdictions, the research seeks to provide actionable
recommendations for developing a comprehensive regulatory framework that safeguards public
interests while fostering technological innovation.
