Abstract
In terms of section 1 of the Electronic Communication and Transactions Act, data messages include “data generated, sent, retrieved or stored by electronic means”.1
This dissertation will discuss the binding nature of electronic communication by reviewing the formalities of electronic contracts in international trade. The discussion will include a comparative study of the Vienna Convention on Contracts for International Sale of Goods (CISG), the United Nations Convention on the Use of Electronic Communications in International Contracts (hereinafter UNCUEC) and the Electronic Communication and Transactions Act as applied in South Africa.
