Abstract
The integration of Artificial Intelligence (AI) technologies in the South African judiciary holds significant promise for revolutionising legal processes, streamlining case management, and enhancing access to justice. This study explores the ethical considerations introduced by AI in the judicial process, thereby emphasising the need for fairness, privacy, and accountability. The dissertation covers diverse AI applications in the judiciary and is aimed at developing a framework to align with the country's legal values while embracing AI benefits. To do this, it examines the advantages, including reduced case backlogs and improved consistency and the disadvantages, such as potential bias in AI algorithms. Mitigating bias impact requires rigorous data selection, transparency, and ongoing monitoring. The study also addresses data privacy concerns, explores the applicability of data protection laws, and highlights the importance of robust data governance. By advocating for transparency in AI decision-making, the research aims to equip judges and legal professionals with an understanding of AI functions and the ethical considerations associated with its use in the judicial decision-making process.
